Welcome to Sauty Media (“we,” “us,” “our,” or the “Platform”), operated by Sauty Media. These Terms of Use (“Terms”) govern your access to and use of our website (https://sautymedia.com) and our social media management platform (collectively, the “Service”).

By creating an account, accessing, or using Sauty Media, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Service.

1. Eligibility

You must be at least 16 years old and capable of forming a legally binding contract to use Sauty Media. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration

• You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Notify us immediately of any unauthorized use or security breach.

3. Use of the Service

You may use Sauty Media to:

• Schedule and publish content to connected social media platforms (e.g., Facebook, Instagram, X/Twitter, TikTok, YouTube).
• Collaborate with team members.
• Access AI-powered tools (e.g., caption generation, content suggestions, templates).
• View analytics and manage multiple social accounts.

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Reverse engineer, decompile, or attempt to extract source code.
• Abuse AI features to generate spam, misleading, or infringing content.
• Violate the terms of any connected social media platform.

4. Social Media Integrations

• Sauty Media connects to third-party platforms via their official APIs (e.g., Meta, X, TikTok).
• You are solely responsible for compliance with those platforms’ terms, policies, and content guidelines.
• We are not liable for actions taken by third-party platforms (e.g., post removal, account suspension).

5. AI Features & Content Ownership

• Your Content: You retain all rights to content you upload, create, or schedule using Sauty Media.
• AI-Generated Output: Content generated by our AI tools (e.g., captions, suggestions) is provided to you under a worldwide, non-exclusive, royalty-free license for your business use. You assume all responsibility for its accuracy, legality, and suitability.
• Training Data: We may use anonymized, aggregated inputs to improve our AI models, but we do not use your specific content to train models for third parties.

6. User Responsibilities

You agree that you will not:

• Post or distribute content that is defamatory, obscene, hateful, or violates intellectual property rights.
• Use the Service to scrape, spam, or interfere with platform stability.
• Share your account with unauthorized users or resell access.

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Fees & Payments

• Sauty Media offers both free and paid (Pro) plans.
• Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law.
• We may change pricing with 30 days’ notice. Continued use after changes constitutes acceptance.

8. Intellectual Property

• The Sauty Media platform, including software, design, logos, and AI models, is owned by us and protected by copyright and other laws.
• These Terms grant you a limited, revocable, non-exclusive license to use the Service—not to copy, modify, or redistribute it.

9. Disclaimers & Limitation of Liability

• The Service is provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or secure operation.
• While our AI tools aim for accuracy, we do not warrant the correctness of AI-generated content.
• To the fullest extent permitted by law, Sauty Media shall not be liable for any indirect, incidental, or consequential damages (including lost profits or data) arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless Sauty Media, its officers, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Service,
• Your violation of these Terms, or
• Your infringement of third-party rights.

11. Termination

• You may delete your account at any time via your dashboard.
• We may suspend or terminate your access for violations of these Terms, illegal activity, or to protect the integrity of the platform.
• Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts located in San Francisco County, California.

13. Changes to These Terms

We may update these Terms periodically. The “Last Updated” date will reflect changes. Continued use of Sauty Media after revisions means you accept the updated Terms.
